On 14 April 2026, the French CNIL published its final recommendation on tracking pixels in emails.
Key points
The rule depends on the purpose of the tracking. The CNIL states that individual opening measurement used to analyse or optimise a marketing campaign requires the recipient's consent. It also provides strict exemptions for certain purposes, including measurement limited to deliverability, subject to conditions.
There is therefore no single answer for every campaign. You must define the purpose, inform recipients and determine the applicable basis with your DPO.
